Federal Court Mandatory Detention Case Won [2010-01-14]
Graves and Doyle were lead counsel for Mr. Saysana's case challenging Immigration and Custom Enforcement's (ICE) overly broad interpretation of mandatory detention. After several successful habeas corpus cases in the Federal District Court of Massachusetts, the government appealed our win in the District Court ordering the Immigration Court to give Mr. Saysana a bond hearing. In late December, the First Circuit Court of Appeals issued their decision in Saysana v. Gillen, No. 09-1179 (1st Cir. Dec. 22, 2009) granting us a great win. In the decision, the Court struck down the government's interpretation of the mandatory detention law and ordered that ICE stop applying the law so broadly against persons in the First Circuit (Massachusetts, New Hampshire, Maine, Rhode Island and Puerto Rico). The First Circuit is the first federal circuit court to consider this mandatory detention issue.
